Dangers of texting and driving in New Jersey

Distracted driving is dangerous no matter what form it takes. Unfortunately, careless driving can cause a fatal accident. Texting while driving happens more often than most think. The National Highway Traffic Safety Administration (NHTSA) reports that more than 3,000 people die each year due to distracted driving. Almost 10% of all fatal crashes in the past six years were the result of a distracted driver. Although many states have passed strict laws banning the use of cell phones while driving, surveys show that drivers are still texting and calling while driving.

The NTSA survey mentioned above states that nearly 700,000 people in the United States use only their cell phone or other electronic device during the day. This number corresponds to roughly 5 percent of all drivers in the country. The group’s research also found that most drivers agree with laws banning texting while driving. However, around 15 percent of drivers admit to texting or emailing while driving. These statistics are very disturbing because they show that distracted driving is a real problem. Texting while driving is clearly a societal problem that has the potential to spread across generations. If you or a loved one has been injured in a distracted driving accident, our legal team is here to help you obtain a fair and reasonable outcome.

Why texting while driving is incredibly dangerous

Texting is dangerous because it requires the driver to take their hands off the wheel when using the phone. This hand movement makes it difficult to control the car. Using the voice command feature is still problematic because it creates a distraction. This is because any cell phone use affects the brain activity needed to drive safely. In fact, a study conducted at the Children’s Hospital of Philadelphia Research Institute showed that brain activity decreases by up to 40 percent when a cell phone is used while driving. The moral of the story is that texting while driving is one of the worst forms of distracted driving because it impairs many of the driver’s senses at once: physical control, attention, and visibility. Phone use is a big problem for Teen Drivers

Teen drivers are more likely to use their phone while driving simply because they grew up in a technology-dominated information age. Next time you’re at an intersection, take a good look inside the cars and you might see one or more young drivers looking down, probably at their phone. According to the Centers for Disease Control and Prevention, drivers under the age of 20 have the highest number of fatal traffic accidents due to distracted driving. If you are involved in such an accident with a teenage driver, it is worth seeing if they were distracted by a phone or other electronic device before the accident.

Legal consequences of careless driving

Accidents caused by distracted driving can cause serious injuries to passengers, cyclists and pedestrians. Moreover, such an accident can negatively change the life of a negligent driver. Such careless driving can lead to personal injury as well as criminal prosecution. Other penalties for distracted driving include expensive fines, license suspension, and even jail time.

If a negligent driver is found to have read or responded to a text message prior to the accident, that driver can be sent to prison for more than a decade or more.
